Car accident with passenger ....app deactivated

    Had a car accident 11 days ago today, i had a passenger, the guy hit us, took fault and his insurance company has taken liability.

    Uber has asked me to take a drug test, which is no problem....im been dragging my feet on that because of some pain ive been in and constant headaches, but i will get that done soon.

    But anyway, im not going through James River even though they asked me to get their app and send them a copy of my personal insurance declarations page.....i did not want to do that....no way....no how....but Louisiana is a no pay no play state and since i was on the app.....with a passenger.....they were the insurance company that was covering me....so they will be verifying i had coverage. My lawyer said its best not to lie because if it comes up later that anyone says u were driving for Uber.......or the passenger mentions it.....it will paint me as a liar.......my personal insurance will say i wasnt covered since i was working (so the no pay no play wouldnt be verified and we would have to use James river to verify anyway) so he said its best to be upfront & honest from the jump

    James Rivers ask for your declarations page to see if you have comprehensive & collision.....because if you don't have it on your personal insurance....they won't cover it either

    Now if i wasn't on the app, and had no sticker in my window i couldve defintely opted to use my personal insurance just to verify i had insurance

    Im just going to wait for the at fault party to fix my car and file for lost wages....but i thought i would've heard something by now....anybody experienced this? How long did it take for them to fix your vehicle?

  2. You should be fine. I'm not sure why JR needs you declarations page. You aren't at fault. Unless the other party is uninsured and JR are going to refuse collision coverage to you unless you have collision on your personal policy.

    The only reason i could think of them needed that is if the at fault driver is Under-insured. He is definitely insured....his company already took liability....but say his policy only covers $25k.....thats where James River would come in at to pick up the difference....thats my theory

    I have to pay for it......they said i'll receive the $40-$50 back once im reactivated & i take my first ride....it'll be automatically added to my earnings for that week.....i will keep y'all updated if they actually do it........or if i have to email them numerous times behind my money

  6. You probably already missed the deadline to take a dig test since you claim this accident was 11 days ago. What's the point in taking a drug test now? You're not drunk or high anymore after 11 days have passed. The other party being at fault is of no consequence since as a "professional" you are to avoid accidents at all costs. Sounds like you're up the creek.

    Nolagal71 may be correct. Drug tests are usually administered within 24 hours or less for these types of things...

  8. Didn't your attorney warn you about posting online ANY details about this accident? Honey, you are smarter than I thought. Lol. Good luck trying to recoup any losses now.

    Thank you for the well wishes! Uber said it wasn't a problem when I submitted my drug test, they understood I was injured, and the email even stated im sure you weren't aware of this rule, so just get your test 24 hours from receiving this email, and I'm sure if someone is on drugs its still in your system for at least a few weeks........that's just my theory, I really don't know.....but, I'm not the least bit concerned about that, my goal is to take care of myself and get better......I know my test will be negative, and I'm sure people on the scene or even my passenger would've noticed if I was "under any influence". But on a positive note, the at fault party will be issuing a check for property damage so I can get my car fixed. Just fyi when I called my attornery to find out when my car would be fixed he said oh, just call their insurance company directly, you can negotiate that yourself, he's only handling the personal injury side.........I have never been in an accident, so I had no clue........but anyway, I will keep y'all updated and I'm hoping this info will we useful if any fellow drivers are in an accident.....hopefully you'll never need this.....best wishes guys....makes lots of money!!!!

    P.S. And yes we will be ignoring all responses from cab driving trolls.....lmao!

    I've been in the same situation as you. Someone hit me and they took responsibility. It was a surprise. I still did all the James River stuff because like you said, no pay no play in Louisiana. The lady who hit me, her insurance paid for everything. The only issue I had was James Rivers took over a week to verify that I had insurance with them. They try everything they can to nullify your insurance with them, hence the drug test. They will also try to get you to pay the 1000$ deductible. Even though I told them that the other insurance co was paying everything they wanted me to pay it anyway. I simply said no, and went on about my business.

    Once your car is fixed you will have to take pictures of where the damage was and submit a ticket saying your car is fixed.

    If you are injured I would get a lawyer on the case. Even if you are not injured you should because you can not drive while your car is being fixed. Thats lost wages they need to make up for as well as any injuries and inconvenience. I have a good lawyer if you need one. She handled my case so she is familiar with how Uber stonewalls cases.

    It took 3 1/2 weeks for me to get my car fixed, but It took 5 days for them to actually acknowledge that I had insurance with them. They did ask for my declarations page just like you. I don't think that its because the guy is under insured, they just don't want to claim you. If your insurance is inaccurate they would love nothing more than to say sorry, you are not covered.     It is recommended that you replace your picture of you to something else on this site. You may notice most posters do not have pictures of themself. ESPECIALLY, if you have an open case.

    I was rear ended in the city of Houston, Tx.

    I was never asked to submit to a drug test so that's really strange to me. Did you get transported by ambulance? I had blood taken on scene but I was told it was to check for diabetes (not sure if true or not).

    My account was deactivated until I showed proof of repairs.

    I didn't have to do any thing with James river (progressive) except having to complete a form that looks similar a police report.

    I had 3 Pax in the vehicle.

    It is best when you have passenger.
    Passenger has a year and a day to sue. James River has lawyers that do this all day every day.
    Let them handle it.
    Without pax ,Uber would never need to know.

  15. This woman is a good person and a good driver for Uber. I don't know her personally,but she has been around a long time and is nice person and very sensible.

  16. Cocaine disappears in 72 hours more or less. Everything else stays up to 28 days or so.
    Used to do D.O.T. drug tests MMS DEPT of Interior Pipelines as pipeline operator part of duties as production operator offshore.
    They put a mirror on one side and stare at other side. Uber test will be joke compared to that one. Just has to be body temp probably 7 panel to 11 panel test.
    All the plants offshore, and casinos hair test nowadays. Hair tests can show if you drank beer from an aluminum can ! They go back at least 6 months or longer.

  19. They only do blood test in Louisiana for fatalities in accidents. It is admission by state that breathalyzer test results may not be sufficiently accurate.
    I can pretty much assure you,once they had your blood,they did whatever they wanted to with it.
    I would have demanded sealed signed chain of command proof by bonded licensed company for any and all biological materials taken.
    It would have to be tamper proof.
    Antibiotics can turn up false sucrose readings in Urinalisis which is a symptom of diabetes. This is why reporting any and all medications is important when urine screening in order to rule out false positives.
    Bilirubin levels( broken down red blood platelets) will tell if sample is washed down or if bladder lavage was used. Temperature can determine if sample was imported via container or obtained elsewhere.

    Sorry Charlie, someone hits me, everyone can deal with my attorney. I'm not jumping through any hoops for Uber and their minimum wage "independent contractor" hustle. I'm not their employee.
